MDC Plus Travel, LLC (d/b/a Voyasea Travel) is committed to transparency in how we conduct our business. We operate in the State of Texas under all applicable state and federal laws; however, our services are available worldwide, with minor regional exceptions. MDC Plus Travel, LLC (d/b/a Voyasea Travel) operates in affiliation with host agencies Legato and WorldVia Travel Network.

This Agreement and Website Terms of Service apply to your use of our services and all interactions across our websites, including mdcplustravel.llc and voyasea.com (collectively, the “Site”), operated by MDC Plus Travel, LLC. These terms may change periodically as legal requirements and business operations evolve. Please review these terms regularly to stay informed of your rights as a client and website user. Part 1: Client-Agency Agreement

1. INTRODUCTION, SCOPE & COMMUNICATION PROTOCOLS

Welcome to mdcplustravel.llc and voyasea.com (collectively, the “Site”), operated by MDC Plus Travel, LLC (doing business as “Voyasea” or “Voyasea Travel”, and collectively referred to as “Company,” “we,” “us,” or “our”). The following Client-Agency Agreement (“Agreement”) and Website Terms of Service (“Terms”) govern your access to and use of our Sites, as well as all travel planning, booking, consulting, and administrative services provided by MDC Plus Travel, LLC and Voyasea Travel (collectively, the “Services”).

  • Role as an Independent Agent & Host Affiliation: MDC Plus Travel, LLC and Voyasea Travel act solely as independent booking agents affiliated with host agencies Legato and WorldVia Travel Network. We book travel on behalf of independent third-party travel suppliers—including airlines, cruise lines, hotels, resorts, tour operators, ground transportation companies, and travel insurance providers (collectively, “Suppliers”).
  • Supplier Liability Disclaimer: Neither MDC Plus Travel, LLC nor Voyasea Travel owns, manages, controls, or operates any of the Suppliers or their travel products. We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier, nor for any personal injury, death, property damage, delay, cancellation, or expense resulting from Supplier operations.
  • Incorporation of Supplier Terms: All travel quotes, itineraries, and reservations booked through MDC Plus Travel, LLC or Voyasea Travel are subject to the separate terms, conditions, ticket contracts, and cancellation policies imposed by the respective Suppliers. By booking through us, you agree to comply with those Supplier terms.
  • Communication & Business Hours: We perform services with reasonable care and professionalism consistent with industry standards. Official communications, quote approvals, and financial authorizations are conducted via email, telephone, or SMS, with email being the required method for formal written records.
    • Standard Hours: Our normal business hours are Monday–Friday, 8:00 AM–5:00 PM Central Time (excluding public holidays). Messages received outside these hours will be addressed as soon as possible on the following business day.
    • Urgent Travel Support: For urgent travel emergencies occurring outside standard business hours during active travel, clients may contact us at +1 (510) 210-3775.
    • Third-Party Delays: Response times from third-party Suppliers are outside our direct control, and any delays caused by Suppliers do not constitute a breach of our service duties.

2. PAYMENTS, PLANNING FEES & DEPOSITS

In Short: Professional planning fees cover custom itinerary design and are strictly non-refundable once work begins. Travel deposits and final balances are billed directly by third-party suppliers.

  • Professional Planning Fees & Fee Schedule: MDC Plus Travel, LLC charges non-refundable Professional Planning Fees for research, custom day-by-day itinerary design, dining/experience curation, and reservation management:
    • US Domestic Planning: $250.00 (up to 2 travelers).
    • International Planning: $550.00 (up to 2 travelers).
    • Additional Travelers: $150.00 per additional person.
    • Scope Revisions: Base planning fees include one initial design and up to two rounds of revisions. Substantial redesigns or complete destination changes after research begins may incur an additional hourly rate of $50.00/hr.
    • Cruises & Simple Hotel Bookings: Direct bookings for standard cruises and single-property hotel stays (without custom daily logistics) are offered with $0.00 in planning fees.
  • Non-Refundability & Scope of Fees: Planning fees are separate from, and in addition to, the cost of travel components (flights, lodging, tours, etc.). Fees cover our dedicated advisory and planning time and are strictly non-refundable once work begins, regardless of whether travel is ultimately confirmed, postponed, or canceled. Fees apply exclusively to the specific itinerary created and cannot be transferred to future trips.
  • Payment Methods & Convenience Fees: Planning fees may be paid by credit card, ACH, bank transfer, or Zelle. Personal checks are not accepted. A 3.5% convenience fee applies to all credit card payments. Convenience fees are waived for payments made via ACH, bank transfer, or Zelle.
  • Billing Statements & Merchant of Record:
    • Planning Fees: Planning fees charged directly by us will appear on your bank or credit card statement as: MDC Plus Travel LLC.
    • Travel Components: All charges for actual travel costs (deposits, final balances, taxes) are billed directly by the respective third-party travel supplier. The supplier’s name (e.g., airline, hotel, cruise line) will appear as the merchant of record on your card statement. You agree not to initiate a credit card chargeback for valid supplier charges or planning fees approved by you.
  • Booking Deposits & Supplier Schedules: Due dates for travel deposits and balances are established by individual travel suppliers and detailed on your itinerary or invoice. Failure to make payments by specified deadlines may result in immediate cancellation by the supplier, subject to supplier penalties, loss of deposit, and price changes.
  • Foreign Currency & Exchange Rates: Quotes in U.S. Dollars (USD) for foreign suppliers are estimates based on rates at the time of quoting. Actual charges processed by foreign suppliers in local currencies are subject to your card issuer’s exchange rates and potential foreign transaction fees. Any variance in foreign currency exchange rates remains the client’s financial responsibility.
  • State Specific Disclosures & Seller of Travel:
    • California Residents: In compliance with California Seller of Travel regulations, California residents will be invoiced for the professional planning fee upon confirmation of travel arrangements. (CA Seller of Travel #2130335-70 via host agency affiliation).
    • Restricted States: Independent travel planning services are currently restricted for residents of Hawaii, Florida, Iowa, and Washington.

3. CANCELLATIONS, REFUNDS & MODIFICATIONS

In Short: Cancellations and refunds are governed strictly by supplier policies. Planning fees paid to us are non-refundable, and suppliers may assess additional cancellation fees or issue credits instead of cash.

  • Client-Initiated Cancellations: All requests for cancellation must be submitted in writing by the primary contact on the booking. Cancellations become effective on the date written notice is received by MDC Plus Travel, LLC (d/b/a Voyasea Travel). Cancellations are strictly governed by the terms, penalty schedules, and cancellation policies of the third-party travel suppliers handling your reservation.
  • Non-Refundable Agency Fees: Professional planning and service fees paid directly to MDC Plus Travel, LLC are completely non-refundable, regardless of the reason for cancellation or whether a trip is completed. MDC Plus Travel, LLC reserves the right to charge a separate administrative fee for processing booking cancellations or major itinerary modifications to cover additional administrative labor.
  • Supplier-Initiated Changes & Cancellations: Third-party travel suppliers reserve the right to modify schedules, alter itineraries, substitute accommodations or transport, or cancel bookings entirely due to operational needs, safety concerns, or circumstances beyond their control. MDC Plus Travel, LLC is not liable for any losses, costs, or inconvenience caused by supplier modifications or cancellations, and supplier rules govern any entitlement to a refund, future travel credit, or rebooking.
  • Refund Processing & Future Travel Credits: Refunds, if applicable, are issued solely at the discretion of the third-party supplier and according to their processing timelines. Refunds will be credited back via the original payment method processed by the supplier. If a supplier issues a Future Travel Credit (FTC) or travel voucher instead of a cash refund, the credit is subject to the supplier’s expiration dates and usage restrictions. MDC Plus Travel, LLC cannot compel a supplier to issue a cash refund in lieu of a credit.

4. TRAVEL INSURANCE RECOMMENDATION & MANDATORY WAIVER

In Short: We strongly recommend purchasing travel insurance. If you choose not to purchase coverage, you assume all financial risk for cancellations, delays, medical emergencies, and lost baggage.

  • Strongly Recommended Coverage: MDC Plus Travel, LLC (d/b/a Voyasea Travel) strongly recommends the purchase of comprehensive travel insurance for all bookings. Unforeseen events can and do occur prior to or during travel, including medical emergencies, trip cancellations, trip interruptions, severe weather, flight delays, lost baggage, supplier insolvency, and emergency evacuation.
  • Client Responsibility & Timelines: It is your responsibility to select, purchase, and review the terms of a travel insurance policy that meets your specific needs. Certain coverage options—such as pre-existing medical condition waivers or “Cancel For Any Reason” (CFAR) coverage—are time-sensitive and typically must be purchased within a strict window (often 10–21 days) following your initial trip deposit.
  • Independent Insurance Providers: We can assist by obtaining and presenting travel insurance quotes from third-party providers upon request. However, all travel insurance policies are contracts strictly between you and the insurance carrier. MDC Plus Travel, LLC is not an insurance underwriter, does not evaluate claims, and cannot guarantee claim approvals. All claims must be submitted directly to the insurance provider.
  • Travel Insurance Waiver: By declining to purchase travel insurance through our recommended providers, or by electing not to purchase travel insurance at all, you acknowledge and agree that:
    1. You assume full financial risk for any losses, penalties, expenses, or non-refundable costs incurred due to trip cancellation, interruption, delays, medical treatment, or emergency evacuation.
    2. MDC Plus Travel, LLC will not refund or reimburse any costs, planning fees, or supplier penalties resulting from your decision not to obtain adequate insurance coverage.

5. PASSPORTS, VISAS & ENTRY REQUIREMENTS

In Short: You are solely responsible for ensuring you have valid passports, visas, entry authorizations, and required documentation for all travelers in your group.

  • Passport Validity & Blank Pages: Clients are solely responsible for ensuring they possess a valid passport for international travel. Most international destinations require that your passport remains valid for at least six (6) months beyond your scheduled return date. Additionally, many countries require at least two to four consecutive blank passport pages for entry and exit stamps. MDC Plus Travel, LLC is not liable for denied boarding or entry resulting from an invalid, damaged, or expiring passport.
  • Visas, Travel Authorizations & Entry Waivers: It is your sole responsibility to research, obtain, and pay for all required visas, entry permits, electronic travel authorizations (such as ETIAS, ESTA, or ETA), and tourist cards prior to departure. Government entry rules change frequently without notice. Boarding will be denied if proper authorization is not presented at departure.
  • Domestic Identification Requirements: For domestic travel within the United States, all adult passengers must present a REAL ID-compliant driver’s license or another TSA-accepted form of identification (such as a valid passport) at airport security checkpoints.
  • Traveling with Minors: Adults traveling internationally with minor children (under 18 years of age) without both legal parents/guardians present may be required to present specific documentation, such as a notarized Letter of Consent signed by the non-traveling parent(s), custody decrees, or birth certificates. You are responsible for carrying all legal documentation required by airlines and border control.
  • Denied Entry & Expenses: MDC Plus Travel, LLC is not responsible if a traveler is denied boarding, entry, transit, or re-entry by any airline, immigration official, or government authority. Any expenses, fines, rebooking fees, or accommodation costs resulting from denied entry or missing documentation are your sole financial responsibility.

6. HEALTH PROTOCOLS, TRAVEL ADVISORIES & ASSUMPTION OF RISK

In Short: You are responsible for meeting health requirements and checking travel advisories. By traveling, you voluntarily assume all inherent health and safety risks.

  • Health & Medical Requirements: Clients are solely responsible for understanding and complying with all health requirements, vaccination protocols, medical testing, and health declarations enforced by destination countries, transit points, airlines, cruise lines, and other travel suppliers. MDC Plus Travel, LLC is not responsible if a client is denied boarding or entry due to failure to meet required medical, vaccination, or testing criteria.
  • Travel Advisories & Warnings: It is your responsibility to stay informed regarding official travel warnings, safety advisories, and public health guidelines issued by relevant government entities—such as the U.S. Department of State (travel.state.gov) and the Centers for Disease Control and Prevention (cdc.gov). By choosing to travel to a destination with active travel advisories or health warnings, you assume all associated risks, safety hazards, and financial consequences.
  • Assumption of Personal Risk: You acknowledge that travel involves inherent risks, including exposure to infectious diseases, illness, injury, or operational disruptions. By proceeding with a booking, you voluntarily assume all risks associated with travel, release MDC Plus Travel, LLC from liability regarding personal health or safety incidents, and agree that any expenses incurred due to illness, quarantine, or unexpected medical treatment during travel remain your sole responsibility.

7. LIMITATION OF LIABILITY, FORCE MAJEURE & DISPUTE RESOLUTION

In Short: Our liability is strictly limited, we are not responsible for events beyond our control (Force Majeure), and any legal disputes will be resolved through binding arbitration in Texas under Texas law.

  • Limitation of Liability: To the maximum extent permitted by applicable law, MDC Plus Travel, LLC (d/b/a Voyasea Travel), its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of our Services, site, or travel arrangements booked through us. Our total cumulative liability for any claims related to our services shall not exceed the total amount of professional agency planning fees paid directly to us by you for the applicable booking.
  • Force Majeure: MDC Plus Travel, LLC is not liable or responsible for any failure, delay, cancellation, operational disruption, or financial loss caused by events beyond our reasonable control (“Force Majeure Events”). Force Majeure Events include, but are not limited to: acts of God, natural disasters, severe weather, fires, floods, earthquakes, epidemics, pandemics, government restrictions, border closures, travel bans, wars, acts of terrorism, civil unrest, strikes, labor disputes, airport closures, flight cancellations, or travel supplier insolvency/bankruptcy. In the event of a Force Majeure Event, any potential refunds or credits remain subject strictly to supplier rules and availability.
  • Indemnification: You agree to defend, indemnify, and hold harmless MDC Plus Travel, LLC, its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or related to your breach of this Agreement, your violation of any third-party travel supplier policies, or your violation of any laws or rights of a third party.
  • Dispute Resolution & Binding Arbitration: In the event of any dispute, claim, or controversy arising out of or relating to our Services or this Agreement:
    • Good Faith Negotiation & Mediation: The parties shall first attempt to resolve the dispute through informal good-faith negotiations. If unresolved after thirty (30) days, the dispute shall be submitted to non-binding mediation before a mutually agreed-upon neutral mediator in Tarrant County, Texas, with costs shared equally.
    • Binding Arbitration: If mediation fails to resolve the dispute, it shall be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The seat and venue for arbitration shall be Tarrant County, Texas. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The prevailing party shall be entitled to recover reasonable attorneys’ fees and legal costs.
  • Class Action Waiver: TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU AND MDC PLUS TRAVEL, LLC AGREE THAT NEITHER PARTY MAY BRING CLAIMS AGAINST THE OTHER AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
  • Governing Law: This Agreement and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Part 2: Website Terms of Service

1. OWNERSHIP & INTELLECTUAL PROPERTY

In Short: All content on this website is owned by or licensed to MDC Plus Travel, LLC and is protected by copyright and trademark laws.

  • Ownership of Content: The Site and its entire contents, features, and functionality—including but not limited to all text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and overall layout—are the exclusive property of MDC Plus Travel, LLC (d/b/a Voyasea Travel) or its content suppliers and are protected by United States and international copyright, trademark, and intellectual property laws.
  • Limited License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site solely for personal, non-commercial purposes. You may view, download, and print pages from the Site for your own personal use in connection with evaluating or booking travel services.
  • Restrictions on Use: Except as expressly permitted above, you may not copy, reproduce, distribute, modify, create derivative works of, publicly display, framed, mirror, scrape, republish, download, store, or transmit any material on our Site without our prior written consent.
  • Trademarks: The names “Voyasea,” “Voyasea Travel,” “MDC Plus Travel, LLC,” and all associated logos, slogans, and product names are trademarks of MDC Plus Travel, LLC. You may not use these marks without our express written permission.

2. PERMITTED USE & PROHIBITED ACTIVITIES

In Short: You agree to use our website only for lawful travel-related purposes and must not copy, steal, or automatically extract our content, or disrupt how the site works.

  • Permitted Use: You may use our Site solely to review travel information, submit legitimate inquiries, request quotes, and manage authorized travel arrangements for yourself or individuals on whose behalf you are legally authorized to act.
  • Prohibited Conduct: When accessing or using our Site, you agree that you will not:
    • Use the Site for any fraudulent, unlawful, or unauthorized commercial purpose.
    • Use any automated software, web crawlers, bots, spiders, scrapers, or other data-mining tools to extract content, data, or media from the Site without our express written consent.
    • Attempt to gain unauthorized access to any portion of the Site, user accounts, computer systems, or networks connected to our servers.
    • Transmit or upload any viruses, Trojan horses, malware, worms, or other malicious code designed to disrupt, disable, or impair website functionality.
    • Frame, mirror, or duplicate any part of the Site, or impersonate MDC Plus Travel, LLC, Voyasea Travel, or another user.
    • Take any action that imposes an unreasonable or disproportionately large load on our hosting infrastructure or network systems.

3. USER SUBMISSIONS, REVIEWS & THIRD-PARTY LINKS

In Short: Content you submit to us may be used to improve or promote our services, and we are not responsible for content on external third-party websites.

  • User Submissions & Feedback: If you submit reviews, testimonials, photos, travel inquiries, suggestions, or other feedback to us through our Site or direct communication, you grant MDC Plus Travel, LLC a non-exclusive, royalty-free, perpetual, and worldwide license to use, publish, adapt, and display that content in connection with operating and marketing our travel services. You represent that you own or have the right to share any content you submit.
  • Third-Party Links & Resources: Our Site contains links to external websites, travel supplier portals, booking engines, and third-party tools (such as airline sites, hotel portals, or travel advisory boards). These links are provided solely for your convenience. We do not control, endorse, or assume responsibility for the content, privacy policies, practices, or security of any third-party websites. Accessing third-party links is entirely at your own risk.

4. DISCLAIMER OF WARRANTIES & WEBSITE AVAILABILITY

In Short: Our website is provided “as is” without guarantees of uninterrupted access or perfect accuracy, though we strive to keep information current.

  • Website Provided “As Is”: The Site and all information, content, materials, and services included on or otherwise made available to you through the Site are provided by MDC Plus Travel, LLC on an “AS IS” and “AS AVAILABLE” basis, unless otherwise specified in writing. We make no representations or warranties of any kind, express or implied, as to the operation of the Site or the accuracy, completeness, or reliability of the information, content, or materials included on it.
  • Service Availability & Maintenance: While we endeavor to keep the Site operational at all times, we do not guarantee uninterrupted, secure, or error-free access to our Site. We reserve the right to modify, suspend, or discontinue any feature, page, or service on the Site at any time without notice for maintenance, updates, or operational reasons.
  • Pricing & Content Accuracy: Travel prices, itineraries, resort amenities, and supplier descriptions listed on our site or provided in quotes are subject to change without notice prior to confirmation. In the event of a typographical error or inaccurate supplier information, we reserve the right to correct any errors and adjust quotes or bookings accordingly.

5. INDEMNIFICATION, GOVERNING LAW & SEVERABILITY

In Short: You agree to protect us from legal claims arising from your improper use of our site, and any website disputes will be governed by Texas law.

  • Indemnification: You agree to defend, indemnify, and hold harmless MDC Plus Travel, LLC (d/b/a Voyasea Travel), its officers, directors, employees, and agents from and against any third-party claims, liabilities, losses, damages, or expenses (including reasonable legal fees) resulting from your violation of these Website Terms of Service or unauthorized use of the Site.
  • Governing Law & Jurisdiction: These Terms of Service and any dispute or claim arising out of or related to your use of the Site shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal or state courts located in Tarrant County, Texas.
  • Severability & Waiver: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
