In Part 1 of our investigation, the facts of this case told a chilling story. We revealed that a passenger, Ms. Diana Sanders, consumed 14 shots of tequila over an 8.5-hour window, consequently blacked out, and was later discovered in a ‘crew-only’ location with several serious injuries. Perhaps most staggering was the silence of the crew—as shot after shot was poured on that January afternoon, not a single ‘blink of an eye’ or intervention came from the staff of the Carnival Radiance. Now, we dig into the corporate rules that governed that day and the silence that followed the verdict.
Exhibit A: The Rules of the Game
For context, here are several excerpts from Carnival’s ‘Cheers!’ beverage package details, which are central to this case:
“RESTRICTIONS:
- Only one drink at a time may be ordered. No sharing is permitted.
- Program allows for up to 15 alcoholic drinks, per 24-hour period (6:00am – 6:00am).
- Once you have consumed your 15 drinks, you cannot purchase any additional alcoholic beverages.
- Please note: Our crew is there to provide you a fun but safe vacation. The responsible consumption of alcohol is a matter shared by guests and our team alike. Carnival reserves the right to refuse service for any reason… even though the Cheers! package provides for up to 15 drinks per day while on the ship, it is not an entitlement, and if a guest is clearly impaired, we may decline service.”

Note: Package details have been updated recently; older versions did not include the specific language regarding “shared responsibility” between crew and passenger. While the package is marketed with a 15-drink “ceiling,” the legal reality is that it is supposed to be managed by human judgment. In the Sanders case, the “shared responsibility” clause failed. The system tracked the revenue, but the “team’s discretion” never pulled the brake..
The 30-Minute “Glitch”
The most contentious moment of the trial centered on the 30-minute void. While Carnival’s digital systems recorded every shot of Sanders’ tequila consumption, the ship’s cameras—a massive network designed for total surveillance—experienced a “technical anomaly” at the exact moment she vanished from the public eye.
In court, Carnival attributed this to a localized server glitch. However, because the cruise line had total control over the evidence, the judge allowed the jury to consider “Spoliation of Evidence.” In other words, without the footage to prove otherwise, the jury was permitted to infer that the video would have shown a security failure—specifically, a restricted door left unsecured.
The Discovery in the Stairwell
The “party” for the Vacaville NICU nurse ended at the base of a steep, steel crew-only stairwell. These areas are industrial zones, typically separated from guests by heavy doors.
Sanders was found by a crew member on routine rounds, bleeding and unconscious. She had bypassed the security perimeter and tumbled down the restricted stairs, sustaining a Traumatic Brain Injury (TBI) and multiple fractures. Due to the severity of her injuries, the ship’s infirmary was bypassed and Ms. Sanders was evacuated to a shoreside trauma center.
The Judgment: April 2026
On April 22, 2026, after only four hours of deliberation, the jury returned a verdict that sent a shiver through the cruise industry.
- The Split: The jury found Sanders 40% responsible for her drinking, but Carnival 60% liable for the security breach.
- The Award: $300,000—an amount $50,000 higher than what Sanders’ own legal team had initially requested.
This verdict marks a significant turning point in maritime law, asserting that a cruise line’s ‘duty of care’ to safeguard restricted areas surpasses a passenger’s personal responsibility for their own intoxication. This shift could compel every major carrier to reevaluate both their security infrastructure and protocols, as well as their alcohol consumption monitoring systems.
The Outreach: Seeking Answers
In pursuit of the truth behind the footage gap and the breakdown of safety protocols, 10MTN RedEye sent formal inquiries to the parties involved.
To Carnival Corp: We requested a specific explanation for the 30-minute technical failure and asked how they reconcile their “shared responsibility” policy with a 14-shot consumption record. Carnival’s initial public reaction has been a “respectful disagreement” and a promise to appeal.
To Diana Sanders: We reached out to her legal counsel to understand the human cost of a TBI on a woman whose career was built on the precision and care of neonatal nursing.

Sailing Away: Final Thoughts
As the Carnival Radiance continues its Baja cruises, the ‘Cheers!’ package remains largely unchanged. However, the lingering question is whether the industry-wide 15-drink limit is still reasonable. For one Vacaville nurse, the answer came at a price that no judgment can truly encompass. The verdict has been reached, and the industry is closely observing. So, the next time you swipe your card, remember that the ship is always watching, even when the cameras claim otherwise.
